1. Acceptance of Terms

By accessing and using ChiroFlow ("the Service," "the App," "our platform"), including our web application and mobile applications available on the Apple App Store and Google Play Store, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

2.1 What ChiroFlow Does

ChiroFlow is a practice management and communication platform designed for chiropractic professionals. The Service allows authorized users to:

• Manage patient appointments and scheduling through integrated calendar systems
• Communicate with patients and leads via messaging
• Use AI-powered phone assistants for inbound and outbound calls
• Track and manage leads and patient contacts
• View call logs, transcripts, and voice messages
• Run automated follow-up campaigns
• Access practice analytics and performance metrics
• Connect with third-party practice management tools

2.2 Platform Availability

ChiroFlow is available as a web application and as mobile applications for iOS and Android. Features may vary between platforms, and some features may only be available on specific platforms.

2.3 Third-Party Integrations

The Service integrates with third-party platforms including GoHighLevel, Twilio, and VAPI. By using these integrations, you acknowledge that:

• Third-party services are governed by their own terms of service and privacy policies
• We are not responsible for the availability or functionality of third-party services
• You are responsible for maintaining valid accounts and credentials with third-party services
• Disconnecting an integration will stop data syncing but may not delete data already stored

3. User Accounts and Access

3.1 Account Creation

To use ChiroFlow, you must create an account with valid information. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

3.2 Account Deletion

You may delete your account at any time by:

• Using the account deletion feature within the app Settings
• Submitting a request through our Account Deletion page
• Contacting us at support@chiroflow.com

Account deletion is permanent. All data associated with your account will be deleted in accordance with our Privacy Policy.

4. Workspaces and Multi-User Access

ChiroFlow uses a workspace model where:

• Each workspace represents a chiropractic practice or business entity
• Workspace owners control access and permissions for workspace members
• Data within a workspace is shared among authorized members
• You may be a member of multiple workspaces
• Workspace owners are responsible for managing member access appropriately

5. AI Phone Assistant

5.1 AI-Powered Calls

ChiroFlow offers AI-powered phone assistants that can handle calls on behalf of your practice. By enabling this feature, you acknowledge and agree that:

• Calls may be handled by an AI assistant, not a human
• Calls may be recorded and transcribed
• AI responses are generated automatically and may not always be accurate
• You are responsible for reviewing and verifying information collected by the AI assistant

5.2 Compliance Responsibilities

When using the AI phone assistant, you are responsible for:

• Complying with all applicable call recording consent laws in your jurisdiction
• Ensuring callers are informed when interacting with an AI system where required by law
• Configuring the assistant's behavior appropriately for your practice
• Monitoring call outcomes and correcting any issues

6. Acceptable Use Policy

6.1 Permitted Uses

You may use ChiroFlow to:

• Manage your chiropractic practice operations
• Communicate with patients and leads for legitimate business purposes
• Schedule and manage appointments
• Use AI phone assistants for practice-related calls

6.2 Prohibited Uses

You may NOT:

• Use the Service for any illegal or unauthorized purpose
• Send unsolicited messages or spam through the platform
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use automated scripts or bots to access the Service (outside of provided APIs)
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the AI assistant to make deceptive, misleading, or harassing calls
• Violate any applicable telecommunications regulations
• Share your account credentials with unauthorized individuals

7. Messaging and Communications

When using ChiroFlow's communication features:

• You are responsible for the content of messages you send
• You must comply with all applicable messaging regulations (TCPA, CAN-SPAM, etc.)
• You must obtain proper consent before sending automated messages
• Message delivery is not guaranteed and depends on third-party carriers
• Standard messaging rates may apply to recipients

8. Intellectual Property

ChiroFlow, including all software, designs, text, graphics, logos, and other content, is owned by ChiroFlow and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

You retain ownership of all data you input into ChiroFlow. By using the Service, you grant us a limited license to use, process, and store your data solely for the purpose of providing the Service to you.

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

ChiroFlow is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The Service will be uninterrupted or error-free
• Data displayed will always be accurate or up-to-date
• The Service will meet your specific requirements
• AI-generated responses will be accurate or appropriate in all circumstances

9.2 Not Medical Advice

ChiroFlow is a practice management tool and does not provide medical advice, diagnosis, or treatment recommendations. All clinical decisions remain the sole responsibility of the healthcare professional.

9.3 Limitation of Liability

To the maximum extent permitted by law, ChiroFlow and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, including but not limited to loss of data, missed appointments, or communication failures.

10. Indemnification

You agree to indemnify and hold harmless ChiroFlow and its affiliates from any claims, damages, losses, or expenses arising out of your use of the Service, your violation of these Terms, or your violation of any applicable laws or regulations, including telecommunications and healthcare privacy regulations.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of material changes through the app, email, or by updating this page. Your continued use of the Service after changes constitutes acceptance of the modified terms. If you do not agree with the updated terms, you should discontinue use of the Service.

We may terminate or suspend your access to ChiroFlow at any time, with or without notice, for:

• Violation of these Terms of Service
• Unauthorized or abusive use of the Service
• Security concerns
• Non-payment of applicable fees
• Extended period of inactivity

You may stop using the Service at any time. To fully terminate your account, use the in-app account deletion feature or visit our Account Deletion page.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of the state in which ChiroFlow is headquartered.
